⚖️ Enforcement & Due Process

Per NC Gen. Stat. §47F-3-107.1, no fine may be imposed without: (1) written notice specifying the alleged violation; (2) a minimum 10-day cure period; and (3) an opportunity to appear before the board. Maximum late dues fees are the greater of $20/month or 10% of the outstanding amount.

📜 Governing Document Hierarchy

Stone Park HOA is governed by: (1) NC General Statutes Chapter 47F, (2) Articles of Incorporation, (3) Declaration of CC&Rs (Mecklenburg County), (4) these Bylaws, (5) Board Resolutions.

Article I — Name, Purpose & Governing Law

The association is Stone Park Homeowners Association, Inc., a NC nonprofit corporation. §47F-3-101

  • Purpose: Maintain and enhance quality, aesthetics, and property values of Stone Park Drive.
  • All planned communities created on or after January 1, 1999 are governed by the NC Planned Community Act. §47F-1-101
  • The HOA fiscal year runs January 1 through December 31.
Article II — Membership & Voting Rights
  • Membership is automatic and mandatory for all lot owners. §47F-3-101
  • Each lot is entitled to one (1) vote regardless of the number of owners.
  • Members in arrears by more than 30 days forfeit voting rights until dues are paid.
  • Tenants do not have voting rights; the property owner retains all membership rights.
  • Bylaw amendments require a two-thirds (2/3) majority vote. §47F-2-117
Article III — Board of Directors
  • The Board shall consist of five (5) directors serving two-year staggered terms. §47F-3-103
  • Officers: President, Vice President, Treasurer, Secretary, and Director-at-Large.
  • Board meetings must be open to all members with at least 10 days' advance notice.
  • A quorum for board action is three (3) of five (5) directors.
Article IV — Meetings
  • Annual Meeting: Held once per year, no later than April 30.
  • Notice must be given at least 10, but no more than 60, days before the meeting. §47F-3-108
  • A quorum is 25% of eligible voting members present in person or by proxy.
  • Meeting minutes must be made available within 30 days. §47F-3-118
Article V — Assessments & Dues
  • Annual assessment: $140.00 per lot, due January 15th each year.
  • Board may increase dues up to 15% per year without a vote; more requires majority approval. §47F-3-115
  • Late charges: $20/month or 10% of outstanding dues after 30 days. §47F-3-115(b)
  • The HOA may place a lien on a lot for unpaid assessments. §47F-3-116
Article VI — Use Restrictions & Architectural Control
  • All lots shall be used for single-family residential purposes only.
  • No structure may be erected or altered without prior written ARC approval.
  • Solar panels may not be prohibited per NC Gen. Stat. §22B-20.
  • The HOA may not prohibit display of the U.S. or NC state flag not exceeding 4x6 ft. §47F-3-121
  • Short-term rentals (Airbnb, VRBO) require prior board notification.
Article VII — Dispute Resolution & Homeowner Rights
  • The association must inform members annually of their right to mediation. §7A-38.3F
  • Before imposing any fine, the board must provide written notice, a 10-day cure period, and a hearing. §47F-3-107.1
  • All financial records and governing documents must be made available to any lot owner upon request. §47F-3-118
  • NC Fair Housing Act prohibits discrimination based on race, color, religion, sex, national origin, familial status, or disability.
